Terms of service
The terms for the Automation Audit, Missed-Call Recovery, websites, Sending Infrastructure and custom automation. It's a one-person business, so "I" below means me, Max DeAngelo.
Who these terms are between
Amplify Automation is the business name of Maxwell (Max) DeAngelo, a sole proprietor in Warrington, Pennsylvania. "You" is the business that buys a service.
If I give you a written quote for a project, it sits alongside these terms. Where the two differ, the quote wins.
The Automation Audit
The audit is $500, paid up front, one time, with no retainer.
- What you get
- A 30-minute walkthrough at your shop in Bucks or Montgomery County, or by screen share if you'd rather. Then 20 checks across your calls, website and quote requests, business email, Google listing, follow-up, office work and Pennsylvania's texting rules. The report arrives within 5 business days of the walkthrough, puts a dollar figure on what it finds and ranks the fixes.
- What you send
- Exports, not passwords: a call-log export and a few forwarded quote requests. I don't need logins to your accounts.
- The report is yours
- To keep and act on however you like, whether or not you hire me for anything else.
- The $500 credit
- If you buy any service from me after the audit, the $500 comes off its upfront price: the setup fee for Missed-Call Recovery (so $1,250 becomes $750), the price of a website build, or the quote for anything else. The credit has no time limit and applies once per audit.
- Refunds
- Cancel before the walkthrough and you get the $500 back in full. Once the walkthrough has happened, the audit isn't refundable.
Missed-Call Recovery
Missed-Call Recovery is $1,250 to set up ($750 after an audit), then $200 a month, month to month. There is no long-term contract.
- Paying
- Half the setup fee is due when you sign up and half when texting goes live. The $200 a month is charged to a card on file: the first time on the go-live date, then on that date each month.
- Going live
- Texting starts once the phone carriers approve your texting number, which can take a few weeks. You approve the wording and the AI assistant's script before anything reaches a real customer.
- If the carriers say no
- If the carriers refuse your texting number for good, or it still isn't approved 60 days after kickoff, you can cancel and get back everything you've paid for Missed-Call Recovery. That doesn't apply when the hold-up is on your side, like registration details I'm still waiting for.
- What the $200 covers
- Everything that keeps it running: the texting number and carrier fees, the AI assistant's call minutes, and wording changes when you ask.
- Fair use
- If your call or text volume ever runs far above normal for a shop your size, I'll talk it through with you before anything changes.
- Cancel before go-live
- Cancel before the kickoff call and you get back everything you've paid. After kickoff, I keep the first half of the setup fee and nothing more is owed, unless the carriers are the reason (see above).
- Cancel after go-live
- Email me any time. Service runs to the end of the month you've already paid for, and nothing is owed after that.
- What you keep
- Your call and text records, exported to you, and the texting number, transferred to you if you want to keep it. Your main business number never changes either way.
Websites
A website is a fixed price: $1,499 for the Starter build (up to 5 pages, live in 10 business days) or $3,799 for the Full site (up to 12 pages, live in 20 business days). Half is due up front to start and half when the site is finished. There is no monthly fee from me, and after an audit the price comes down by $500.
- Timing
- The clock starts once your photos and domain access are in. Days spent waiting on your sign-off don't count.
- The words
- I write them from the kickoff call and anything on your current site worth keeping. You read and approve every page before launch.
- You own it
- The domain is registered in your name and the site is hosted in an account you own. If you stop working with me, it keeps running. Your domain renews with its registrar for about $10 to $25 a year, paid by you.
- Fixes
- Anything that doesn't work as promised gets fixed free for 30 days after launch. After that, changes are quoted before any work starts.
- Cancelling partway
- If you cancel during a build, I keep the first half and hand over the work done so far.
Sending Infrastructure and custom automation
These are quoted per project. Before any work starts, you get a fixed quote in writing with the scope, the price, the timeline and every tool subscription the work needs, so the ongoing costs are clear up front. After an audit, the quote comes down by $500.
- Paying
- Unless the quote says otherwise, half is due up front and half on delivery.
- Where it runs
- In accounts you own wherever possible (your Google, Microsoft, Jobber or QuickBooks account, for example), so your data stays with you. Tool subscriptions are billed to your own accounts. If one can't be, the quote lists it and what it costs.
- Afterward
- You get a walkthrough of what was built. When something needs to change, you reach me directly, and changes outside the quote are priced before any work starts.
Invoices
I send invoices by email, in US dollars, for the audit, setup fees, builds and quoted work. You can pay by card or bank transfer, and an invoice is due when you receive it. No work starts on a build until its first payment is in. If a monthly charge fails and stays unpaid for 14 days, the service pauses until it's paid.
Your part
Give me accurate information, the exports and access a job needs, and your approvals in reasonable time. A build's timeline pauses while it waits on you. You keep ownership of your accounts, data and customers.
Texts and emails in your name
Anything I set up sends in your business's name, with wording you approve. I build it to follow the rules this site describes (Pennsylvania's texting law, including its quiet hours and opt-outs, and Gmail's and Outlook's sender rules), but that's practical guidance, not legal advice. Your business stays responsible for how it contacts its customers. If someone brings a claim over a text or email sent in your name, your business handles it and covers its costs, unless it came from a mistake in how I set things up.
Your data
I use it only to do the work, never sell it, and share it only with the services that run the work (like the texting provider). When we stop working together, I export what's yours to you, delete my copies within 30 days and remove my access.
Other companies' services
The texting provider, the AI calling service, hosting and email providers have their own terms and outages. I'll work around problems on their side where I can, but I can't promise their uptime.
Limits
Beyond the fixes described above and in your quote, my total responsibility for any claim is limited to what you paid me for that service in the three months before the claim (for a one-time service, its price), and I'm not responsible for lost profits or other indirect losses.
Changes to these terms
If they change, the new version goes on this page with its date. A change never alters a quote you've already accepted. Pennsylvania law governs these terms.
